ACHESON, Circuit Judge.

This was an action brought by Emma R. Muir against the Preferred Accident Insurance Company of New York upon a policy of insurance issued by that company bearing date May 16, 1900, whereby, in consideration of an annual premium of $24, it insured Walter H. Muir for a term of one year against the effects of bodily injury caused solely by external, violent, and accidental means, and agreeing (inter alia) :

“(d) That if death shall result from such injury within 90 days from the date thereof, the company shall pay the sum of $5,000 to Emma R. Muir (wife) if surviving,” and
