The following is all the testimony in relation to the assessment of taxes, for non-payment of which the lands in controversy were sold : “ The defendant introduced as evidence on the trial, the original book of assessments of lands for taxes in Barbour county, Alabama, for the year 1853, in the handwriting of J. This is an action of ejectment under the Code, by the appellee against the appellant. The issue is joined on the plea of the general issue. The plaintiff’s title to the land is derived as follows : A patent from the United States to Eli S. Shorter and John S. Scott.
