Plaintiff in error, Frank Jones, (hereafter called defendant,) was indicted, jointly with George Gusike, by the Madison county grand jury for robbing James Cross of a watch while armed with a revolver, with intent, if resisted, to kill or maim Cross. Defendant was tried alone, found guilty, and after overruling a motion for a new trial was sentenced to imprisonment in the penitentiary. He was twenty-five years old.
