Giovanni Barcelona (“Barcelona”) appeals the motion court’s denial, without an evidentiary hearing, of his Rule 29.15 motion for post-conviction relief (“Amended Motion”) by the Circuit Court of Lafayette County. Barcelona was convicted after a jury trial of class D felony of unlawful use of drug paraphernalia, class D felony of failure to appear, and misdemeanor offenses of operating a vehicle without a valid license and making a false police report.
