The facts disclosed by the evidence upon the trial of this case are as follows:

About six o’clock p. m., on December 19, 1948, Horace R. Pierce, a sergeant in the United States Army, stationed at Florida Military District, Jacksonville, Florida, while driving an Army truck was proceeding south'through Tifton, Georgia, on Main Street, approaching its intersection with Fifth Street.
