This was an action of assumpsit brought by appellees against appellant for moneys had and received. The declaration contains the common counts only, to which there was a plea of the general issue. The case was submitted to the court for trial, without the intervention of a jury. The court rendered a judgment in favor of the plaintiff for §218.80, and the defendant brings the case here by appeal.
