¶ 1. Willie Joe Ross appeals the trial court’s denial of his motion for post-conviction relief (PCR) as time-barred pursuant to Mississippi Code Annotated section 99-39-5 (Supp.2011). Ross raises the following assignments of error: whether (1) his claim of an illegal sentence is excepted from the time bar; (2) the trial court lacked jurisdiction to accept his guilty plea without an indictment from the grand jury on the charge of grand larceny; and (3) he improperly pleaded guilty to the charges in the multi-count indictment because the *1081larceny charge merged with the…
