*407This was an action to recover damages for the wrongful death of the plaintiff’s intestate, in which there was a demurrer to the evidence by the defendant which was overruled, and judgment entered for the plaintiff for the sum of $5,000; being the amount of damages assessed by the jury in their verdict. The overruling of the demurrer to the evidence is the error assigned.
