About November, 1917, Duesenberg Motors Corporation was manufacturing engines of various types in a recently constructed plant at Elizabeth, N. J., and had a well-established business. On November 20,1917, the Duesenberg Corporation entered into a contract with the United States to furnish the necessary organization plant and facilities, including increased facilities necessary to produce 500 Liberty motors, for which the government agreed to pay cost as defined in the contract, plus a fixed profit.
