During a jury trial, defendant Siemon Moore moved to suppress his videotaped statement to the police. The trial court granted Moore’s motion to suppress and the State requested leave to file an interlocutory appeal of the trial court’s suppression order. The trial court granted the State’s motion and declared a mistrial based on a finding that manifest necessity required the discharge of the jury while the State took its interlocutory appeal.
