MEMORANDUM OPINION

WILSON, District Judge.

This is an action pursuant to 30 U.S.C. § 1276 of the Surface Mining Control and Reclamation Act of 1977 (“SMCRA”). The plaintiffs, Harvey Catron and Jo D. Molinary (“Catron and Molinary”), seek judicial review of an administrative decision (“the decision”) rendered by the defendant Bruce Babbitt, Secretary of the Interior (“the Secretary”), through the Interior Board of Land Appeals (“IBLA” or “the Board”).
