In accordance with the act of 1893, which regulates the method of pleading in civil actions in this State, the plaintiff brought his action in the city court of Atlanta for damages for the non-performance by the defendant of a contract for the purchase of certain real estate, by reason whereof he was prevented from earning certain commissions which otherwise he would have earned, and to which he was entitled under his agreement with the defendant.
