This is a criminal action wherein Mark Johnson and Orlando Underwood were convicted, by a jury, of aggravated robbery (K.S.A. 21-3427). The defendants were arrested on May 28, 1980, a short distance from the convenience store they were later accused of robbing. The original information alleged that on the 28th day of May, 1980, the defendants “did then and there unlawfully, willfully, take the property, to-wit: United States Monies from the person of and in the presence of another, to-wit: Richard Koonce by threat of bodily harm to the person…
