The appellant, Larry Wayne Guess, was charged by separate indictments with having committed the offenses of robbery in the first degree, assault in the first degree, and kidnapping in the first degree, as proscribed by §§ 13A-8-41(a)(1), -6-20(a)(1), and -6-43(a)(4), Code of Alabama 1975, respectively. After a trial on the consolidated charges, Guess was found guilty of assault in the first degree and kidnapping in the first degree; he was acquitted of the charge of robbery in the first degree.
