This was a suit brought by appellant, Marley Harrison, a minor, who sued by Jacob Harrison his next friend, against appellee William Allen, to recover damages occasioned by the discharge of a gun in the hands of appellee while these parties, together with others, were hunting on November 24, 1910.

The declaration on which the case was tried, contained three counts in case, each stating the conditions under which appellant was injured as claimed by him, alleging due care on the part of appellant, negligence on the part of appellee, and charging that appellant was in view of and near to appellee…
