This case presents the issue of whether the District Court properly entered judgment for Dallas Power & Light Company (DP&L) based on jury answers to 13 questions submitted pursuant to F.R.Civ.P. 49(a). 1 The jury fixed Ford Motor Company’s (Ford) damage at $473,649.00 for flood damages to approximately 650 Ford, Mercury and Lincoln-Continental used automobiles stored on property located below the DP&L Mountain Creek dam. 2 The jury concluded in answers to questions 4 and 8 that the existence of DP&L’s dam caused the water to rise more rapidly than if there had been…
