The plaintiff was the owner of a lot situated on Plymouth avenue, in the city of Eochester, along which the defendant’s grantor had constructed a horse railroad in the center of the street. After acquiring the franchise to use and operate a street railroad, which belonged to its grantor, another corporation, the defendant constructed its road on the ■side of the street between the curb and the sidewalk in front of the plaintiff’s premises.
