delivered the opinion of the court.

Carlos E. Eossi. brought an action of debt against Juan Eivera Santos. In order to secure the effectiveness of the judgment and having noticed that the defendant frequently drove an automobile of the Studebaker make, he decided to make sure whether the automobile belonged to defendant before levying any attachment. To that end he asked Francisco Aguirre, the representative of the Studebakers, who was the owner of the automobile which he had seen Juan Eivera Santos drive.
