The plaintiff in error brought an action against the defendant in error to recover the sum of $835.00, alleged to have been deposited with the defendant by John Stone, the intestate in his lifetime and never drawn out by him. Three pleas are filed, to which the plaintiff filed special replications, upon which the defendant joined issue and the case went to trial before a jury, which resulted in a verdict and judgment in favor of the defendant.
