MEMORANDUM OPINION AND ORDER DENYING PLAINTIFF’S MOTION FOR RELIEF FROM JUDGMENT

On July 18, 2005, the Plaintiff, John S. Clark (“Clark”), filed his original complaint seeking damages for RICO violations, common law fraud and conversion. On July 26, 2005, Defendants Lockout Corporation (“Lockout”) and Elvis Clint McBay moved to dismiss Clark’s lawsuit, alleging that Clark failed to state a claim upon which relief can be granted.
