MEMORANDUM OPINION AND ORDER

FRANCIS, United States Magistrate Judge.

This case concerns the application of modern copyright law to designs embodied in an ancient medium: carpets. The plaintiff, David Shaw Nicholls, alleges that the defendants, Tufenkian Import/Export Ventures, Inc., d/b/a Tufenkian Carpets, and its principal, James Tufenkian, infringed his “Prado” design with two similar designs known as “Eclipse” and “Total Eclipse,” and thereby violated the Copyright Act of 1976, 17 U.S.C. § 101 et seq.
