Appeal by the defendant, The New York Central and Hudson Elver Eailroad Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Eensselaer on the 16th day of May, 1914, upon the decision of the court, the facts having been stipulated and submitted for determination to the court without a jury.

This is an appeal from a judgment rendered against the defendant for the value of certain piano actions delivered by the plaintiff to the defendant at Castleton, N. Y., oh January 24 and 31, 1910, for carriage to Eichmond, Ind. The articles were lost after delivery at Muncie, Ind., to the last connecting carrier, the Chicago, Cincinnati and Louisville Eailroad Company, which was then being operated by a receiver appointed by the United States Circuit Court of Indiana in 1909.
