This cause originated when the plaintiff, Lem Binnion, instituted an action to set aside two quitclaim deeds, one from himself to his niece, Lucille Clark, dated March 9, 1945, and the other from Lucille to her lawyer. The theory of his action was that Lucille, through the agency of her lawyer, was guilty of fraudulently concealing material facts in procuring the deed. 23 Am. Jur., Secs. 76-83, pp. 850-863.
