CADENA, Justice.

Appellant, Richard Cusson, complains of the refusal of the district court to set aside the order of the Firemen’s and Policemen’s Civil Service Commission of the City of San Antonio dismissing him from his position as patrolman in the San Antonio Police Department.

Appellant does not here contend that the procedural requirements prescribed by the Firemen’s and Policemen’s Civil Service Act (Article 1269m, Vernon’s Tex.Rev. Civ.Stat.Ann. [1963]) were not followed, nor is there any doubt that, following the entry of the dismissal order by the commission, appellant timely…
