STEPHENSON, Justice.

This is an appeal from an order of the trial court holding defendant’s plea of privilege was waived, and if not waived, that it be overruled. The parties will be referred to here as they were in the trial court.

The chronological order of the unusual events occurring in this case transpired as follows: Plaintiff, Dick Hohman, filed his original petition in Dallas County suing defendant, Camden Oil Company, for commissions due.
