This case comes here on appeal from a judgment for appellee, Thomas O. Selfridge, in the supreme court of the District, on a verdict directed by the court.

On the 26th of December, 1907, appellee, defendant be'low, appeared in the police court of the District and made oath that “twelve curtains of the value of $300, * * * of the goods and chattels of said Thomas O.
