The parties in this action are husband and wife. Upon the trial of this action before a referee plaintiff recovered a *3judgment against the defendant- Both parties have appealed and hereafter will be designated as plaintiff and defendant. The facts out of which this litigation arise are briefly as follows: George R. Finch, a resident of Glens Falls, N. Y., died January 12, 1906; he left him surviving this plaintiff, his widow, and no descendants; he was worth, at the time of his death, about $800,000.
