delivered the opinion of the court:

The defendant, Eugene Clerk, was arrested and charged in an amended complaint with aggravated assault, criminal damage to property, unlawful use of a weapon, possession of burglary tools and burglary with intent to commit a felony. After a finding of probable cause was entered in a preliminary hearing on the charges of burglary and possession of burglary tools, the prosecutor also filed an information, which contained counts of burglary with intent to commit rape, attempt rape, and possession of burglary tools.
