Joseph Haul, the testator, died in Brooklyn on the' 2éth day of' January, 1899. His widow, Eliza Haul, his son, Henry Haul, and seven grandchildren, children of a deceased son, Joseph, who died intestate in Brooklyn on or about the 9tli day of July, 1897, survive *293him, and these grandchildren are the respondents, plaintiff and defendant. The will of the said Joseph Haul was admitted to probate by the Surrogate’s Court by a decree dated April 17,1899, and upon an appeal coming to this court the decree was affirmed.
