MEMORANDUM OPINION

ROBERT E. PAYNE, Senior District Judge.

This matter is before the Court on the DEFENDANT’S MOTION TO RECONSIDER COURT’S DENIAL OF MOTION TO SUPPRESS STATEMENTS AND EVIDENCE (Docket Nos. 21, 25). For the reasons set forth below, the motion will be granted.

PROCEDURAL BACKGROUND

The Defendant, Bobby A. Davis, was charged in a three-count Indictment. Count One charged Davis with Possession with Intent to Distribute Cocaine Base in violation of 21 U.S.C. § 841.
