DIETRICH, District Judge.
This action is brought by the United States to recover from Charles G. Hoyt as principal, and his codefend-ant as surety, $2,916.50 and interest, which it is claimed the defendant Hoyt has failed to account for and pay over, as was his duty to do. Hoyt was appointed by the Secretary of the Interior as one of three commissioners to negotiate treaties with the Crow, Flathead, and other Indian tribes, under the provisions of an act of June 10, 1896 (29 Stat. 341, c. 398) and of June 6, 1900 (31 Stat. 302, c. 785).
