delivered the opinion of the Commission of Appeals, Section B.

Relator was the duly elected, qualified and acting tax assessor in and for Tarrant County, Texas, during the year 1925. Respondent is "Comptroller of public accounts of the State of Texas and was holding said office when this controversy arose. It is admitted that relator faithfully performed his official duties, as prescribed by law, during the year 1925.
