Esther Whetton, appellant, beneficiary of a $10,000 life insurance policy of Dr. V. J. Sloan, now deceased, was sued by Vernon J. Sloan, Dr. Sloan’s son, appellee, in an action seeking cancellation of that part of the insurance policy changing the beneficiary from the insured’s son, Vernon, to the insured’s unmarried consort, the appellant, the grounds of the requested cancellation being those of mental incapacity and undue influence.
