A somewhat extended recital of the record is essential to a clear understanding of the issues and questions presented for decision. The facts are either stipulated or are not in serious dispute. On October 23, 1919, the city council of the city of Boone entered into a written contract with Anderson-Deering Company, appellant, to construct a sanitary sewer in Fairview Addition to said city, known as Fairview Addition sewer.
