Clark County used an alternative to the competitive bidding process to select Tidewater Barge Lines (Tidewater) as the vendor for a solid waste disposal contract. Washington Waste Systems (hereinafter WWS), a disappointed bidder, challenged the use of the alternative procedure and the selection of Tidewater. The trial court ruled that Clark County could not use the alternative procedure for this contract, but did not find the selection of Tidewater to be arbitrary and capricious.
