The plaintiff in error, Walter E. Fickle, was convicted in the district court of Adair county upon the charge of having committed the detestable and abominable crime against nature by penetration per os, the jury leaving his punishment to be assessed by the court. The court sentenced the defendant to imprisonment in the penitentiary for the term of five years. To reverse the judgment an appeal was perfected by filing in this court on April 5, 1926, petition in error with case-made.
