This was a rule, obtained by the executors of Brownjohn, and other creditors of Charles Hurst, upon the marshal, to bring into court the money levied upon an execution of Timothy Hurst against Charles Hurst, to be disposed of among the applicants according to the priority of their judgments. This being a case of the first impression, and arising out of a state law, I have only to regret that it has fallen to the lot of this court to give a con-struetion to it, before it had been considered and decided upon by the supreme court of this state.
