The appellant is a corporation maintaining a bridge across the Lehigh river in New street in the City of *9Bethlehem. The intervening appellee is a street railway company operating a street car line over the appellant’s bridge. The use of the bridge by the railway company is authorized and regulated by an agreement dated July 2, 1910, which among other things fixes the compensation to be paid the bridge company for the use of the bridge; t'he basis for such compensation being the number of passengers carried by the railway company.
