The Court previously trifurcated the issues to be tried in this case. The first phase which addressed the question of whether jurisdiction exists under the Clean Water Act, 33 U.S.C. § 1251 et seq. (“CWA”) was tried to the Court on February 6, February 7, February 11, February 12, February 13, February 14, February 20, February 26, and February 27, 2003.
