In determining the issues raised in this action, under the pleadings and evidence, it becomes necessary to decide whether either of the objections raised by the plaintiff to the goodness of the title tendered by the defendant to the plaintiff, of the land which the plaintiff had agreed to purchase of the defendant, is valid. By the terms of sale, the balance of the purchase-money was required to be paid on June 27, 1879, at an hour and place specifically desig*44noted, when and where the deed would.be ready for delivery.
