Defendant-appellant, Anthony J. Scherer, Jr., appeals from the order of the district court, which denied a petition to vacate his conviction for certain violations of the Gun Control Act of 1968. 1

In 1974, Scherer was found guilty of nine counts of failure to record the disposition of firearms in violation of the Gun Control Act, and was sentenced to concurrent two-year terms for each count.
