On 30 January, 1923, plaintiff, whose place of business is in Raleigb, N. C., entered into a contract in writing with defendant, 0. B. Riddle, by which plaintiff agreed to ship to defendant at Burlington, N. C., a sufficient number of the text-books adopted by the State Text-Book Commission to supply the demands of the schools in the vicinity of Burlington.
