APPEAL from the Jefferson Circuit Court.

1Opinion of the CourtElliott, J.

— Redman was indicted, in the Jennings Circuit *206Court for an assault and battery with -intent to murder. The case was transferred by a change of venue to the Jefferson Circuit Court, where he was tried and convicted, the jury assessing his fine at one dollar, and that he be imprisoned in the state prison for the term of two years. Motion for a new trial overruled, and judgment on th'e finding of the jury. The defendant appeals.

Several questions are presented and urged as grounds for a reyersal of the judgment, which will be examined in their order.
