PHILLIPS, District Judge. District Judge.

This is an action for breach of a coal supply contract between Sigmon Coal Company, Inc. (Sigmon), and the Tennessee Valley Authority (TVA). The court tried this civil action without a jury commencing on September 2, 2003. Following the trial, the parties filed proposed findings of fact and conclusions of law.
