This is a proceeding in Surrogate’s Court for advice and instruction (Surrogate’s Ct. Act, § 215). The widow of decedent and a sister of decedent appeal from a decree approving a proposed sale of the three-quarter interest of the estate in a parcel of real property located on 1st Avenue in the borough of Manhattan, adjacent to the site of the United Nations buildings.
John Kenneth Taylor, decedent, and James E. Murphy were close friends. In 1946 Taylor and Murphy purchased the property in question, improved with six tenements. Taylor contributed 75% of the price-and Murphy 25% of the price.…
