McCORD, Judge.

This is an appeal from a conviction for embezzlement with a penalty of four years confinement in the penitentiary.

1. Appellant seeks a reversal, first, upon the ground that the bill of indictment is insufficient in that it omits to state the value of the money embezzled; second, that the facts disclosed the relation of debtor and creditor between appellant and the prosecuting witness, and that the court erred in not charging the jury that if the money was loaned to the defendant by the prosecutrix, and the relation of debtor and creditor existed, he could not be guilty of…
