The plaintiff in error, hereinafter called defendant, was convicted in the district court of Pottawatomie county on a charge of robbery with firearms and his punishment fixed at imprisonment for twenty years in the state penitentiary.

The defendant argues but two questions in his brief: First, that the court erred in refusing to give the defendant sufficient time to prepare his defense.
