The proceedings brought under review by the writ of certiorari herein have to do with the project for improving the watercourse known as Canaseraga creek and its tributaries in the valley between Mt. Morris and Dans*266ville in Livingston county, which scheme, in 1905, was first laid before the River Improvement Commission, -a hoard created by chapter 734 of the Laws of 1904; and the plan adopted by that Commission was approved and the work authorized to he done by a special -act (Laws of 1906, chap. 419).
