—Appeal by the defendant, by permission, from an order of the County Court, Nassau County (Kowtna, J.), dated November 1, 1999, which denied his motion pursuant to CPL article 440 to vacate a judgment of conviction rendered February 11, 1997.

Ordered that the order is affirmed.
