In this contract dispute involving the sale of real property, the trial court denied Fox Run Properties, LLC’s efforts to withdraw its admissions following a failure to timely respond to discovery and subsequently granted summary judgment and a decree of specific performance to James M. Murray. The trial court in turn denied summary judgment to Fox Run. Fox Run appeals, arguing that the trial court abused its discretion in refusing to allow Fox Run to withdraw its admissions, in granting summary judgment to Murray, and in denying summary judgment to Fox Run.
